Often called a “digital footprint,” the internet has become yet another challenge in the world of law. While social media has provided us with a way to share experiences and connect with people all over the globe, it has also proven itself to be detrimental if not handled with care. With the freedom to post as we please, comes a responsibility to be conscious of what we post. This is even more important for those with pending legal cases.
It may be tempting to make a Facebook post to vent about your situation, but defense attorneys, insurance companies, and others may be scouring your social media pages for anything that can diminish your integrity. For instance, posting pictures or videos of yourself doing physical activities while suing for debilitating injuries isn’t something you want brought forth in front of a judge or jury. Posting confidential information regarding your case may cause interference and prevent you from receiving the compensation you deserve.
“But what if my profile is private?” There is a false sense of security that comes with being able to make your accounts and your posts private. Although you may be doing everything in your power to keep things private, the posts you make can be shared by a friend or by social media companies themselves. Comments that you make on other people’s posts or posts/comments made by your friends and family can also be seen and accessed. With that in mind, keeping your profiles private is a good start to maintaining a cleaner digital footprint.
The best strategy when you have an open legal claim is to limit or to avoid using social media altogether until the case is closed. Opposing parties are keen to find any discrepancies to discredit your side or bolster their own stance, so it is important to be mindful of your social media presence. If you do happen to post something that could potentially be damaging to your case, do not delete the post and discuss with your attorney the best course of action. Deleting relevant content may be viewed as spoliation of evidence and there may be legal consequences. Your digital presence is just as important today as your words and your actions; remember that it can be used to represent you everywhere, including legally.
